Bob Jones, an experienced truck driver, worked for Continental Paving. After working for the company for one year, Bob noticed that the back-up alarm on his trip working. A company mechanic determined that the alarm needed to be replaced. The company had none in stock, so the mechanic instructed Bob to drive the truck without the alarm. A month later, Bob and other Continental drivers were delivering asphalt to a work site on a highway at an intersection. A police officer directed the construction vehicles. A different driver asked the officer to "watch our backs" as the trucks backed through the intersection. All the other trucks other than Bob's were equipped with back-up alarms. When it was Bob's turn to back up, he struck the police officer, killing him. The state charged Continental Paving with motor vehiclehomicide. Will the company be found guilty?
